By accessing or using HealthfulAI (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the Service.

HealthfulAI is a Software-as-a-Service platform providing healthcare-related tools and analytics. The Service is intended for professional use by healthcare providers and organisations, not for direct patient use.

You must:

• Be at least 18 years old.
• Have authority to enter into this agreement on behalf of your organisation.
• Comply with all applicable laws, including healthcare regulations.

You agree to provide accurate and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of your login credentials.

You agree to:

• Use the Service only for lawful purposes.
• Not upload or transmit harmful code, unauthorised data, or infringe intellectual property rights.
• Ensure any patient data shared complies with applicable privacy laws (including the Privacy Act 1988 and Notifiable Data Breaches scheme).

HealthfulAI processes sensitive health information. We comply with:

• Australian Privacy Principles (APPs).
• Notifiable Data Breaches Scheme. You must obtain all necessary consents before uploading personal health information.

Subscription fees are payable in advance as per your selected plan. All prices include GST unless stated otherwise. Late payments may result in suspension of access.

All intellectual property in the Service remains with HealthfulAI. You receive a non-exclusive, non-transferable license to use the Service for your internal business purposes.

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance and unforeseen outages may occur.

To the maximum extent permitted by law:

• HealthfulAI is not liable for indirect or consequential loss.
• Liability is capped at the fees paid in the preceding 12 months. Consumer guarantees under Australian Consumer Law apply and cannot be excluded.

We may suspend or terminate your account for breach of these Terms. You may terminate by providing 30 days’ written notice. Upon termination, you may request data export within 14 days.

Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to our data practices.

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
